Terms of Use

These Terms of Use (“Terms”) govern your access to and use of mobile applications and related services published by NeonGold LLC, including IdleCuber, MyChromaTime, and other NeonGold software (collectively, the “Apps”).

By downloading, accessing, or using the Apps, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Apps.

1. Who we are

The Apps are provided by NeonGold LLC, a Colorado limited liability company.

2. Eligibility

You must be able to form a binding contract where you live. If you are under the age of majority, you may use the Apps only with permission of a parent or legal guardian who agrees to these Terms.

The Apps are not directed to children under 13.

3. License to use the Apps

Subject to these Terms, NeonGold grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, solely for your personal, non-commercial use (including entertainment, lifestyle tracking, or other uses described in a given App).

You may not:

• Copy, modify, distribute, sell, or lease any part of the Apps
• Reverse engineer or attempt to extract source code except where allowed by law
• Bypass security, save integrity, or purchase systems
• Cheat, exploit bugs for unfair advantage, or disrupt other users’ use (including any future online features)
• Use the Apps for any unlawful purpose

All rights not expressly granted are reserved by NeonGold and its licensors.

4. Accounts

The Apps do not require a NeonGold account. Progress and local data are stored on your device unless a future update adds optional cloud or account features (in which case additional terms may apply).

Purchases and restores may use your Apple ID or Google account through the platform stores. Those accounts are governed by Apple’s or Google’s terms.

5. Virtual items and in-app purchases

The Apps may include virtual currency, items, cosmetics, boosts, crates, or similar content (“Virtual Items”), and may offer in-app purchases.

5.1 No real-world value

Virtual Items are licensed, not sold, as digital content. They have no cash value, are not redeemable for real money, and cannot be transferred outside the Apps except as the Apps expressly allow.

5.2 Purchases

Paid purchases are billed by Apple or Google under their terms. Prices may vary by region and platform. NeonGold does not control store pricing display beyond configuring product offerings.

5.3 Refunds

Refund requests are handled by Apple or Google under their refund policies, except where law requires otherwise. Contact the store first for billing issues.

5.4 Consumables and progress

Some Virtual Items are consumable (for example, currencies or crate charges). Local progress and Virtual Items may be lost if you delete the App, change devices without a supported restore path, or clear app data. Non-consumable entitlements (such as a supporter / no-ads pack) may be restorable through the platform’s restore-purchases flow when IAP is enabled.

5.5 Crates and random rewards

Some features grant randomized in-app rewards (for example loot crates). These are not gambling, do not pay out real money, and are not a wagering service. Odds or drop information may be described in the App where required.

6. Advertising

The Apps may show advertisements, including rewarded ads that you choose to watch for in-app benefits. Ads may be provided by third parties such as Google AdMob. Ad-related data practices are described in our Privacy Policy.

If you own an applicable no-ads entitlement, ads will be suppressed as described in the product offer.

7. Updates and availability

We may update, change, suspend, or discontinue the Apps (or any feature) at any time. We do not guarantee uninterrupted or error-free operation. Some features may require a network connection when ads or purchases are enabled.

8. Intellectual property

The Apps, including software, art, audio, text, trademarks, and branding, are owned by NeonGold LLC or its licensors and are protected by intellectual property laws. “NeonGold,” “IdleCuber,” “MyChromaTime,” and related marks are trademarks of NeonGold LLC where asserted.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE PLACES, THIS SECTION APPLIES TO THE FULLEST EXTENT ALLOWED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEONGOLD LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APPS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APPS OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO NEONGOLD LLC (IF ANY) FOR THE APPS IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES, THIS SECTION APPLIES TO THE FULLEST EXTENT ALLOWED.

11. Indemnity

You agree to defend and indemnify NeonGold LLC against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Apps or violation of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Apps at any time by uninstalling them. We may suspend or terminate access if you violate these Terms or if we discontinue the Apps. Sections that by nature should survive (including intellectual property, disclaimers, limitations, and governing law) will survive termination.

13. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your place of residence apply.

14. Changes to these Terms

We may update these Terms by posting a revised version at https://neongold.gold/terms with a new effective date. Continued use after changes means you accept the updated Terms. If you do not agree, stop using the Apps.
